Terms and Conditions

Booking arrangements:
The person making the booking and any participants in the booking will be deemed to have accepted these booking conditions.

Brochure/Website:
Any brochure/website information should be used as a guide only.

Changes in prices and itineraries:
Prices and itineraries are correct at time of publishing however they may be subject to seasonal changes, peak period demands, changes in fees, taxes or currency fluctuations.

Booking Changes/Cancellations:
If you change/cancel your booking your change/cancellation fee may be up to 100% of the price. If you withdraw from all or part of your tour after commencement, the full charge will be applicable.

Maps, photographs and videos:
Maps, photographs and videos are shown for general information and may not necessarily reflect the routings, exact locations, events or services provided at the time of your trip.

Health, Indemnity and Immigration:
You are responsible for all visa, passport, immigration, quarantine, customs, health and other requirements of the country visited. A valid passport with at least 6 months validity must be carried by each traveller. We are not responsible for your failure to comply with these requirements.

Travel Insurance:
Travel insurance is highly recommended and relevant travel insurance can be booked through us. You may also manually choose your own insurer.

Air travel:
Air travel is subject to the conditions and limitations of liability set out in the airline’s conditions of carriage and is not our responsibility

Events beyond our control:
We do not accept liability whatsoever for injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events, which are beyond its control including but not limited to, war, civil disturbance, fire, floods, acts of god, acts of government or any other authorities, accident, change of schedule, or failure of machinery or equipment or industrial action.

Limit of liability:
To the extent permitted by law, Dany Island excludes all liability for any loss or damage whatsoever.

All visitors and guests have full responsibility for their own safety and for those within their group.

Visitors and guests are not to swim in the ocean unless they are sober, confident swimmers, and comfortable with the conditions. Common sense must be used as there is there is no lifeguard or medical assistant on duty. Fires are not to be started on Dany Island by guests or visitors.

Destination enquiries:
Dany Island makes no representations as to the safety, conditions or other issues that may exist at your destination at the time you are there. You should obtain travel advice, including from the Australian Department of Foreign Affairs and Trade.

Conservation Area:
Dany Island and its surrounding reefs are part of a government-certified Community Conservation Area for the wellbeing and environmental longevity of the reefs, land and marine life. Upon entering within 100m of the outer reefs surrounding Dany Island, you must comply fully with the CCA Management Plan and all the rules/regulations of Dany Island.

Law of contract:
These booking conditions are governed by the laws of Vanuatu and any action arising under them or in any way connected with the booking may be brought only in a court in Vanuatu, subject to any law which is expressly inconsistent with this.
